Terms of Service

The service

Kotobia is a language learning app that combines flashcards, stories and lessons, and an AI voice tutor. The AI tutor and generated content can make mistakes and are for learning practice only. They are not a substitute for professional instruction, translation, or advice.

Your account

You sign in with a magic link sent to your email. You are responsible for keeping access to your email secure and for activity under your account. You must be at least 16 years old to use Kotobia.

Plans, trials, and billing

The free plan includes flashcards and the first story level at no cost. New accounts also get a time-limited AI trial of the voice tutor and drills, with no credit card required; after it ends, AI access requires a paid subscription. Separately, a Pro subscription may begin with a time-limited free trial that requires a payment method on file and converts to a paid subscription automatically unless canceled before it ends.

Paid subscriptions (Pro) are billed in advance through our payment processor, Stripe, on a monthly or annual basis at the price shown at checkout. Subscriptions renew automatically until you cancel. You can cancel anytime from Settings, and you keep access until the end of the current billing period. Except where required by law, payments are non-refundable. We may change prices for future billing periods with notice.

Practice with the AI tutor is subject to fair-use limits (a daily or weekly allowance shown in the app). We may adjust these limits to keep the service sustainable.

Acceptable use

Please do not misuse the service. In particular, do not: try to access it through automated or bulk means, circumvent usage limits or security, resell or redistribute the service or its generated content, upload content you do not have the rights to, or use the service to violate any law or another person's rights.

Your content

If you import your own material (for example a deck of words), it stays associated with your account, and you keep whatever rights you already held in it. You are responsible for having the right to use anything you import. You grant us the limited permission needed to store and process your content so the service can work for you.

Our content

The app, its software, the curriculum, stories, lessons, and other materials we provide are owned by us or our licensors and are protected by intellectual property laws. We grant you a personal, non-transferable license to use them for your own language learning while your account is in good standing.

Disclaimers

The service is provided on an "as is" and "as available" basis, without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted, error-free, or that generated content will be accurate.

Limitation of liability

To the maximum extent permitted by law, Kotobia and its operators will not be liable for any indirect, incidental, special, or consequential damages, or for lost data or profits, arising from your use of the service. Our total liability for any claim relating to the service will not exceed the amount you paid us in the twelve months before the claim.

Termination

You may stop using the service and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the service and its users. You can export your data before deleting your account.

Governing law

These Terms are governed by the laws of the State of Washington, United States, without regard to conflict-of-laws rules. Any disputes will be resolved in the state or federal courts located in Washington, unless applicable law requires otherwise.

Changes

We may update these Terms as the product evolves. We will revise the date above and, for material changes, give notice in the app or by email. Continued use after changes take effect means you accept the updated Terms.
